AN ACT Relating to a spawning channel for salmon on the Skagit river; creating a new section; making an appropriation; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     The department of fisheries shall develop a plan for constructing and operating a spawning channel for salmon on the lower Skagit river.  The department shall be assisted in determining the location and use of the channel by an advisory committee. The advisory committee shall consist of representatives appointed by the governor from the following groups:

          (1) The Puget Sound gilnetters association;

          (2) The Puget Sound  purse seiners association;

          (3) The Washington state reef net association;

          (4) A representative of the Washington state salmon sports fishermen; and

          (5) A representative of the Indian tribes that would be entitled by treaty right to share in the catch of the salmon produced by the spawning channel.

          The plan shall be submitted for review to the natural resources committees of the senate and house of representatives by August 1, 1988.  The committees shall make any recommendations they may have to the department on the plan within sixty days of receipt of the plan.

          Based on the plan developed under this section and any recommendations of the natural resources committees of the senate and house of representatives, the department shall construct the spawning channel and place it into operation by June 1, 1989.

          This section shall expire June 30, 1989.

 

 

          NEW SECTION.  Sec. 2.     The sum of forty-eight thousand dollars, or so much thereof as may be necessary, is appropriated from the general fund to the department of fisheries for the biennium ending June 30, 1989, for the planning and construction of the spawning channel under this act.

 

          NEW SECTION.  Sec. 3.     This act is necessary for the immediate preservation of the public peace, health, and safety, the support of the state government and its existing public institutions, and shall take effect immediately.
