AN ACT Relating to state casualty losses; adding new sections to chapter 43.79 RCW; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     (1) The state self-insurance reserve account is established in the state treasury.  Monthly, the state treasurer shall deposit in the account five-tenths of one percent of state general fund revenues, excluding federal funds.

          (2) Moneys in the account may be appropriated exclusively for state casualty losses.  However, moneys in the account may be appropriated for other lawful purposes if:

          (a) The appropriation receives the affirmative vote of sixty percent of each house of the legislature; or

          (b) The account exceeds five percent of state general fund biennial expenditures, excluding federal funds.  However, the appropriation may only be made to the extent the account exceeds the five-percent level.

          (3) Earnings accrued to the account shall be credited to the account, notwithstanding RCW 43.84.090.

 

          NEW SECTION.  Sec. 2.     (1) The state transportation self-insurance reserve account is established in the motor vehicle fund.  Monthly, the state treasurer shall deposit in the account five-tenths of one percent of state motor vehicle fund revenues, excluding federal funds.

          (2) Moneys in the account may be appropriated exclusively for state transportation casualty losses.  However, moneys in the account may be appropriated for other lawful purposes if:

          (a) The appropriation receives the affirmative vote of sixty percent of each house of the legislature; or

          (b) The account exceeds five percent of state motor vehicle fund biennial expenditures, excluding federal funds.  However, the appropriation may only be made to the extent the account exceeds the five-percent level.

          (3) Earnings accrued to the account shall be credited to the account, notwithstanding RCW 43.84.090.

 

          NEW SECTION.  Sec. 3.     Sections 1 and 2 of this act are each added to chapter 43.79 RCW.

 

          NEW SECTION.  Sec. 4.     This act shall take effect July 1, 1989.
