AN ACT Relating to prohibition of certain types of agricultural fertilizers; adding a new section to chapter 15.54 RCW; and prescribing penalties.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 15.54 RCW to read as follows:

          (1) The director shall not allow, nor shall any person use, any product as an agricultural fertilizer which contains raffinate or like material which contains any of the following:  (a) Radioactive uranium, radium, or thorium; (b) toxic solvents; or (c) toxic heavy metals.

          (2) Any person violating this section is guilty of a gross misdemeanor under chapter 9A.20 RCW.
