AN ACT Relating to child care; adding new sections to chapter 43.19 RCW; adding a new section to chapter 48.14 RCW; and making an appropriation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 43.19 RCW to read as follows:

          (1) The risk manager shall establish a risk management pool to cover liability claims against child care providers in excess of fifty thousand dollars.  The pool shall be funded by assessments against child care providers who elect to participate in the pool and any appropriations made for this purpose by the legislature.  Assessments shall be determined by the risk manager and shall be imposed and collected as prescribed by the risk manager.

          (2) The risk manager shall institute a continuing education program for child care providers participating in the pool established under subsection (1) of this section.  All child care providers participating in the pool under subsection (1) of this section shall participate in the continuing education program.  The program shall be designed to increase the safety of child care facilities and reduce the risk of accidents.

          (3) Title 48 RCW does not apply to the risk management pool established under this section.

          (4) The risk manager shall adopt rules to implement this section.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 43.19 RCW to read as follows:

          The child care revolving fund is hereby established in the custody of the state treasurer.  The risk manager shall deposit in the fund all moneys received from assessments under section 1 of this act.  Moneys in the fund may be spent only for the purposes of section 1 of this act, including costs of administration.  Disbursements from the fund shall be on authorization of the risk manager.  The fund is subject to the allotment procedure provided under chapter 43.88 RCW, but no appropriation is required for disbursements.

 

          NEW SECTION.  Sec. 3.  A new section is added to chapter 48.14 RCW to read as follows:

          The taxes imposed in RCW 48.14.020 do not apply to premiums or assessments collected or received under section 1 of this act.

 

          NEW SECTION.  Sec. 4.     The sum of five million dollars, or so much thereof as may be necessary, is appropriated from the general fund to the child care revolving fund for the biennium ending June 30, 1989, to carry out the purposes of this act.
