AN ACT Relating to the revision of comprehensive county solid waste management plans and city solid waste management plans; and amending RCW 70.95.110.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 11, chapter 134, Laws of 1969 ex. sess. as amended by section 7, chapter 123, Laws of 1984 and RCW 70.95.110 are each amended to read as follows:

          The comprehensive county solid waste management plans and any city solid waste management plans prepared in accordance with RCW 70.95.080 shall be maintained in a current condition and reviewed and revised periodically by counties and cities as may be required by the department.  Upon each review such plans shall be extended to show long-range needs for solid waste handling facilities for twenty years in the future, and a revised construction and capital acquisition program for six years in the future.  Each revised solid waste management plan shall be submitted to the department.

          Each plan shall be reviewed and revised within five years of June 7, 1984, and thereafter shall be reviewed, and revised if necessary, at least once every five years.

          If within three years after a county has by resolution or ordinance announced that it will prepare a revised comprehensive solid waste management plan, any city in the county has neither agreed to prepare a joint city-county plan pursuant to RCW 70.95.080(2) nor authorized the county to prepare a plan for the city pursuant to RCW 70.95.080(3), the county has no further requirement to plan for or provide disposal sites for that city.  If a city within a county determines to become part of a county's comprehensive solid waste management plan, the city and county shall enter into an interlocal agreement under chapter 39.34 RCW that commits the solid waste stream of the city to the use of the county for the duration of the interlocal agreement.
