AN ACT Relating to deferred prosecution; creating a new section; and repealing RCW 10.05.010, 10.05.015, 10.05.020, 10.05.030, 10.05.040, 10.05.050, 10.05.060, 10.05.070, 10.05.080, 10.05.090, 10.05.100, 10.05.110, 10.05.120, 10.05.130, 10.05.140, 10.05.150, 10.05.160, and 10.05.170.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     (1) The select committee on deferred prosecution is created, consisting of two members from each of the majority and minority caucuses in the house of representatives and the senate, selected by the respective caucus chairpersons.  The committee may expand its membership by the addition of nonvoting members from those organizations likely to be most interested in the deferred prosecution programs.

          (2) The committee shall study and analyze the goals, implementation, and need, if any, for the continuance of deferred prosecution programs and shall report its findings to the house judiciary and senate law and justice committees no later than January 1, 1989, after which time the select committee on deferred prosecution shall cease to exist.  The committee shall review, with particular emphasis, deferred prosecution programs in conjunction with RCW 46.61.502 and 46.61.504.

          (3) Legislative members of the committee shall be reimbursed for travel expenses as provided in RCW 44.04.120.  Members of the committee who are not legislators shall be reimbursed for travel expenses as provided in RCW 43.03.050 and 43.03.060.

 

          NEW SECTION.  Sec. 2.  Effective July 1, 1989, the following acts or parts of acts are each repealed:

                   (1) Section 1, chapter 244, Laws of 1975 1st ex. sess., section 26, chapter 47, Laws of 1982 1st ex. sess., section 4, chapter 352, Laws of 1985 and RCW 10.05.010;

          (2) Section 5, chapter 352, Laws of 1985 and RCW 10.05.015;

          (3) Section 2, chapter 244, Laws of 1975 1st ex. sess., section 6, chapter 352, Laws of 1985 and RCW 10.05.020;

          (4) Section 3, chapter 244, Laws of 1975 1st ex. sess. and RCW 10.05.030;

          (5) Section 4, chapter 244, Laws of 1975 1st ex. sess., section 7, chapter 352, Laws of 1985 and RCW 10.05.040;

          (6) Section 5, chapter 244, Laws of 1975 1st ex. sess., section 8, chapter 352, Laws of 1985 and RCW 10.05.050;

          (7) Section 6, chapter 244, Laws of 1975 1st ex. sess., section 4, chapter 158, Laws of 1979, section 9, chapter 352, Laws of 1985 and RCW 10.05.060;

          (8) Section 7, chapter 244, Laws of 1975 1st ex. sess., section 10, chapter 352, Laws of 1985 and RCW 10.05.070;

          (9) Section 8, chapter 244, Laws of 1975 1st ex. sess., section 11, chapter 352, Laws of 1985 and RCW 10.05.080;

          (10) Section 9, chapter 244, Laws of 1975 1st ex. sess., section 12, chapter 352, Laws of 1985 and RCW 10.05.090;

          (11) Section 10, chapter 244, Laws of 1975 1st ex. sess., section 13, chapter 352, Laws of 1985 and RCW 10.05.100;

          (12) Section 11, chapter 244, Laws of 1975 1st ex. sess., section 14, chapter 352, Laws of 1985 and RCW 10.05.110;
