AN ACT Relating to motor vehicle crimes; amending RCW 9A.56.070; and reenacting and amending RCW 9.94A.320.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

Sec. 1. Section 9A.56.070, chapter 260, Laws of 1975 1st ex. sess. and RCW 9A.56.070 are each amended to read as follows:

(1) Every person who shall without the permission of the owner or person entitled to the possession thereof intentionally take or drive away any automobile or motor vehicle, whether propelled by steam, electricity, or internal combustion engine, the property of another, shall be deemed guilty of a felony, and every person voluntarily riding in or upon said automobile or motor vehicle with knowledge of the fact that the same was unlawfully taken shall be equally guilty with the person taking or driving said automobile or motor vehicle and shall be deemed guilty of taking a motor vehicle without permission.

(2) Every person who, having obtained an automobile or motor vehicle with the owner's permission, wilfully retains that vehicle after the period for which permission has been granted or after demand for the return of the vehicle has been made shall be deemed guilty of taking a motor vehicle without permission.

(3) Taking a motor vehicle without permission is a class C felony.

Sec. 2. Section 3, chapter 115, Laws of 1983 as last amended by section 4, chapter 187, Laws of 1987 and by section 1, chapter 224, Laws of 1987 and RCW 9.94A.320 are each reenacted and amended to read as follows:
