BACKGROUND:

 

Currently when a vocational technical institute wishes to purchase materials from a single source of supply, they must comply with the competitive bidding process rather than negotiating directly with the sole supplier.  This bill passed the Education Committee in 1988 in its current form.

 

SUMMARY:

 

Vocational technical institutes would be excused from complying with competitive bidding procedures when a purchase is clearly and justifiably the sole source to provide the facilities, services or equipment.  Justification shall be based on uniqueness or sole availability at the location required.  The purchaser shall negotiate the best possible price.

 

EFFECT OF SENATE AMENDMENTSWaiver of competitive bid procedures and allowing purchase from a sole source supplier may occur if the school district board of directors finds there is clearly and legitimately a single source of supply.  The vocational technical institute seeking such authority, must submit a written request for the waiver.

House Committee - Testimony For:    It is important that the public vocational technical institutes be allowed to efficiently and effectively secure services, equipment and materials.  The waiver of the competitive bidding process in sole source supply situations will enable the institutes to negotiate for the best price possible and to take advantage of equipment and facilities that are unique and become available to the institute.  This will also assure that students are instructed on equipment that is the industry standard.
