BACKGROUND:

 

The Legislature enacted the Local Transportation Act in 1988.  This act authorized local governments to develop and adopt programs for the purpose of jointly funding from both public and private sources transportation improvements necessitated by economic development and growth within their jurisdictions.  Local governments were required to adopt these programs by ordinance and the programs were required to identify areas affected by the off-site transportation improvements, a program based on a long-term transportation plan identifying the specific transportation improvements associated with the plan, and a six-year capital program to accomplish those improvements.  The local governments were authorized to impose a transportation impact fee on developers to pay a transportation impact fee for off-site transportation improvements.

 

SUMMARY:

 

Language is clarified in the Local Transportation Act of 1988 regarding credits for developers constructing off-site transportation facilities.  These facilities are more clearly identified as transportation improvements, making that term consistent with definitions set forth in the chapter and terminology used in the section.

 

EFFECT OF SENATE AMENDMENTSTechnical corrections are made to effectuate intent of the bill.
