BACKGROUND:

 

Currently when a school district or a vocational-technical institute wishes to purchase materials from a single source of supply, it must comply with the competitive bidding process. There is no authority to negotiate directly with the sole supplier.

 

SUMMARY:

 

Vocational technical institutes are excused from complying with competitive bidding procedures when a supplier is clearly and justifiably the sole source to provide the facilities, services or equipment.  Justification shall be based on uniqueness or sole availability at the location.  The purchaser shall negotiate the best possible price.

SUMMARY OF PROPOSED SENATE AMENDMENT:

 

Vocational-technical institutes are required to apply in writing for approval from school district boards of directors before entering into sole source arrangements.  Ongoing waivers may be for specific time periods or items, or both.
