Changing provisions relating to sunset review of programs and agencies.

BACKGROUND:

 

Several changes in the sunset review and termination schedule have been recommended as a result of a workload study by the Legislative Budget Committee (LBC).

 

SUMMARY:

 

The due date of the sunset report by the Official of Financial Management (OFM) is changed to September 1 from September 30 of the year prior to sunset termination.

 

The Nursing Home Advisory Council termination date is extended from 1991 to 1992, removed from the sunset schedule, and recodified in the enabling statute (Chap. 18.51 RCW).  The Governor must make recommendations to the Legislature concerning its continuation by December 1, 1991.

 

The Emergency Medical Services Committee termination date is extended from 1991 to 1992, removed from the sunset schedule, and recodified in the enabling statute (Chap. 18.73 RCW).  The Governor must make recommendations to the Legislature as to the committee's continuation by December 1, 1991.

 

The termination date for regulation of acupuncture practice remains the same (1992) but is removed from the sunset schedule.  The Governor must make recommendations to the Legislature about continuation of the program by December 1, 1991.

 

The Washington State School Director's Association is incorporated into the Sunset Act for termination in 1998, instead of being required under its enabling legislation (Chap. 28A.61 RCW).

 

Several other programs and entities are removed from the sunset schedule but recodified in their enabling statutes:

 

      --The authorization of export trading companies; termination is schedule in 1994 instead of 1992 (Chap. 53.31 RCW);

 

      --The regulation of parimutuel wagering at satellite locations (RCW 67.16.200 through -.230); and

 

      --The Migratory Waterfowl Art Committee (RCW 43.131.359 and -.360).

 

The regulation of motor vehicle warranties ("lemon law") is continued indefinitely by removing its sunset termination provisions.  An LBC cost-benefit study of the state employee incentives program under the State Productivity Board is eliminated.
