BACKGROUND:

 

Federal law establishes the maximum income which may be retained by the spouse of a person who receives Medicaid funded nursing home care, but allows states to set lower income limits.  Washington State law directs the Department of Social and Health Services to establish these income limits as the maximum allowable under federal law, subject to state appropriations or within available resources (Chapter 74.09 RCW).

 

The 1989-91 biennial appropriations act established this maximum at $1,000 per month for the community spouse.

 

SUMMARY:

 

The maximum monthly income allowance for the community spouse of a Medicaid eligible nursing home resident is increased to $1,500.
