BACKGROUND:

 

Current law permits breweries and domestic wineries that are licensed as beer and wine manufacturers to sell the products of their own making for consumption on the premises without having to obtain retail liquor licenses.  Breweries or domestic wineries desiring to sell additional alcoholic beverages for on-site consumption may do so only after obtaining a class H restaurant license.  Current law does not allow breweries or domestic wineries to apply for any other types of retail liquor licenses.

 

SUMMARY:

 

Wineries that are licensed by the state to manufacture wine are allowed to apply for a beer retailer's license, class B, and upon the granting of this license are permitted to sell for on-site consumption malt liquor produced by licensed breweries.  Breweries that are licensed by the state to manufacture malt liquors are allowed to apply for a wine retailer's license, class C, and upon the granting of this license are permitted to sell for on-site consumption wines produced by licensed domestic wineries.

 

 

EFFECT OF PROPOSED SUBSTITUTE:

 

The provision allowing licensed wineries to apply for a beer retailers license and to sell malt liquors is removed from this act.
