The point of all this, frankly, is right now, I have actually heard the Governor say, ‘I don’t agree with that rule, but that is my agency and I let them manage it.’ Well, you know what, no one elected this agency. He hired them; they report to him and he ought to know the rules that they are propagating and he ought to be responsible for them, such as we are to be responsible for the laws we pass. To the good lady from Bellingham, you know if the Lieutenant Governor can’t get out of bed to sign the fishing season law or whatever, we have a problem on our hands. If the agency director can get out of bed, I guarantee the Lieutenant Governor would get out of bed.”

       On page 5, after line 37, insert the following:

"(8) Within two hundred days of the effective date of a rule of the type described in subsection (6) of this section, an agency shall make a good faith effort to notify businesses affected by the rule of the requirements of the rule and how to obtain technical assistance to comply. For purposes of this section, "good faith" means: (1) The agency at least notifies businesses in the standard industrial classifications or their successor identified in the rule-making file as businesses affected by the rule that are registered with the department of revenue; or (2) For rules imposing additional requirements on persons or firms licensed, registered, or operating under a permit, the agency notifies those persons or firms holding the license, registration or permit. The notification shall announce the rule change, briefly summarize the rule change, and include a contact for more information. Notification may be by individual notice, agency bulletins or newsletters, or any other means that will reasonably inform affected businesses. Failure to notify a specific business under this section does not invalidate a rule or waive the requirement to comply with the rule."

       Renumber the sections consecutively and correct any internal references accordingly.

Limiting the rule-making authority of certain entities to those instances where there is a specific grant of legislative authority.

MOTION


      Senator Gardner moved that the following amendment be adopted:

       On page 34, after line 33, insert the following:

       "Sec. 37. RCW 70.155.030 and 1994 c 202 s 1 are each amended to read as follows:

       (1) No person shall sell or permit to be sold any tobacco product through any device that mechanically dispenses tobacco products unless the device is located fully within premises from which minors are prohibited or in industrial worksites where minors are not employed and not less than ten feet from all entrance or exit ways to and from each premise. The board shall adopt rules that allow an exception to the requirement that a device be located not less than ten feet from all entrance or exit ways to and from a premise if it is architecturally impractical for the device to be located not less than ten feet from all entrance and exit ways.

       (2) Beginning January 1, 2003, rules adopted pursuant to subsection (1) of this section must prohibit self-service displays of tobacco products. In-store tobacco products in places where food is sold or stored for public consumption must be displayed in a manner that is not accessible to the general public without the assistance of the retailer or an employee of the retailer. This section does not apply to retailers who sell tobacco products exclusively nor to sales within premises where minors are prohibited by statute."



POINT OF ORDER


      Senator Sheahan: “A point of order, Mr. President. I submit that the amendment by Senator Gardner on page 34, after line 33, is beyond the scope of Senate Bill No. 6252. The underlying bill deals with rule making authority of various agencies. It does only one thing. The bill states that agencies may only adopt rules derived from a specific grant of legislative authority, rather than relying solely on general enabling provisions. The same language is placed in every section of the bill. The amendment has nothing to do with rule making authority. It addresses self service displays of tobacco products. So, I would suggest that the amendment clearly changes the scope and object of the bill.”

      “The President, therefore, finds that the proposed amendment does change the scope and object of the bill and the point of order is well taken.”

      Senator Franklin: “Senator West, my question is one that--yes frustration levels as it refers to the agencies is very, very high in many ways. My question to you in this bill is latitude or leverage, because they can only go by what is stated. What happens if circumstances change? What latitude do they have? This really concerns me. Is this realistic to have?”

      Senator West: “Senator Franklin, it is realistic. Let me give you an example of a responsible state agency and a responsible state agency director. I might use his name here–Fred Kiga--when he ran the Department of Revenue. It was not uncommon; in fact it was his common practice that when the Department of Revenue in our audit came up to a situation where they encountered and said, ‘Well, you know we don’t have the legislative authority to rule this way. We can’t point to a specific piece of legislation authority, so let’s go to the Legislature and have them tell us how to do it.’

      “When I was Ways and Means chairman, I suspect Senator Loveland and now Senator Brown--they would come in and report. It was very refreshing, frankly, to have an agency head do this and to say, ‘Look, we think this is the way it ought to be, but you are the Legislature, please change the law and tell us that is the way you want it done.’ That is a responsible agency. If all agencies worked that way, we wouldn’t be talking about this legislation today. So, yes, I do think it is feasible.”

      Senator Carlson: “Senator Poulsen, if there is a company that establishes a branch outside of the state or other kind of related items, would your bill mean that they would lose the opportunity or would be required to repay the taxes, if it was a branch or other kind of connection?”

       Senator Poulsen: “I don’t believe that is the case. That certainly wasn’t my intent. My intent is that if the entire company moves out of state, we shouldn’t be continuing to subsidize that company. We should hold them accountable for the public benefit that they have enjoyed. Thank you.”
