WHEREAS, In 1985, Michael “Terry” McCarthy began his tenure with Washington State Ferries as superintendent of finance and administration; and
WHEREAS, Terry, as he is most commonly referred to, epitomizes the finest qualities in a public service executive, as he has an infinite capacity for hard work, vision and talent; and
WHEREAS, McCarthy’s steady and focused leadership provided stability during times of transition and difficult challenges; and
WHEREAS, Terry is always willing to assist legislators by agreeing to talk to any audience about ferries, no matter where they are or how antagonistic they might become; and
WHEREAS, His grasp of WSF operations, budget and the legislative process has proved pivotal in policy and operational matters; and
WHEREAS, On October 24, 2001, Washington State Ferries presented McCarthy with an award for his thirty years of state service; and
WHEREAS, The entire WSF organization, including the WSF executive team, thanks Terry McCarthy for his many years of leadership, vision and dedicated service in his roles as finance and administration superintendent, acting director/CEO, and finally as deputy director;

Today is seventy-five years to the day that legislators marched up here from downtown Olympia to occupy the newly constructed legislative building. Construction of the current legislative building was controversial. Can you imagine that? It was controversial almost from statehood in 1889, until the completion in 1927.
“The plan was to occupy the building at the start of the 1927 session. Governor Hartley and the other members of the Capitol Committee got into a royal squabble. Does that sound familiar? That was just one of many--over the costs of furnishing the Senate and the House Chambers. As a result, it wasn’t ready for occupancy until March 7, the first Monday in March and the fifty-seventh day of the sixty day session.
“Older members grumbled at having to march up the hill to the new building as most were staying in hotels down town. In spite of the hardship, they completed their legislative work, as we all do. So, I would like to say, ‘Happy Seventy-fifth, Legislative Building.’”

"NEW SECTION. Sec. 1. A new section is added to chapter 82.08 RCW to read as follows:
(1) The tax levied by RCW 82.08.020 shall not apply to the sale of printed material distributed through the United States mail at no cost to the recipient. As proof of exemption, the buyer must provide the seller with an exemption certificate in a form and manner prescribed by the department.
(2) For purposes of this section:
(a) "Printed material" means human-readable information produced on paper via offset-lithography, letterpress, gravure, or similar processes. It includes pamphlets, flyers, brochures, catalogs, letters, circulars, and coupon books.
(b) "At no cost to the recipient" means the recipient is not charged or billed for the printed material and/or gives no consideration in exchange for the printed material.
(c) "Recipient" is a person, other than the buyer of the printed material, to whom the printed material is distributed.
NEW SECTION. Sec. 2. A new section is added to chapter 82.12 RCW to read as follows:
(1) The provisions of this chapter shall not apply in respect to the use of printed material that is distributed through the United States mail at no cost to the recipient.
(2) The definitions in section 1 of this act apply to this section."
POINT OF ORDER
Senator Brown: “A point of order, Mr. President. I believe the amendment exceeds the scope and object of the bill and would ask for a ruling. I object to the amendment on two grounds. I believe the amendment changes the scope and object of the bill in violation of Rule 66 and that the amendment, if adopted, would violate Rule 25, which requires the bill to have one subject which must be expressed in the title.
“I will explain the points briefly. Number 1, Substitute Senate Bill No. 6822 imposes a use tax on an instate retailer on advertising materials printed out-of-state for the retailer and mailed directly to Washington residents. The amendment creates a sales and use tax exemption for all items sent by mail that are printed using certain printing methods. I believe the amendment is beyond the scope and object of the bill because, (1) The subject of the Substitute Senate Bill is the use tax. The subject of the amendment is the sales tax; (2) Senate Bill No. 6822 applies to out-of-state printers printing these advertising materials. The amendment applies to all printed materials sent by mail by anyone in the state; (3) Substitute Senate Bill No. 6822 increases revenues to the state general fund. The amendment reduces revenues to the state general fund.
“Number 2, I believe the amendment would violate Rule 25, which requires the bill to have one subject and to have that subject expressed in the title. The title of the bill is ‘An Act relating to clarifying that use tax is due on direct mail advertising pieces printed out-of-state and mailed directly to Washington residents to promote the sale of goods or services by Washington residents.’ The amendment provides a sales and use tax exemption for items printed in the state that are mailed to persons inside or outside the state. This is not expressed in the title of the bill. Thank you, Mr. President.”
