EMERGENCY RULES

     Date of Adoption: June 11, 2001.

     Purpose: Amend personal use fishing rules.

     Citation of Existing Rules Affected by this Order: Repealing WAC 220-56-25500V; and amending WAC 220-56-255.

     Statutory Authority for Adoption: RCW 77.12.047.

     Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.

     Reasons for this Finding: These regulation changes are in accordance with provisions of the Halibut Catch Sharing Plan and have been endorsed by representatives of the National Marine Fisheries Service and the International Pacific Halibut Commission. There is insufficient time to promulgate permanent rules.

     Effective Date of Rule: Immediately.

NEW SECTION
WAC 220-56-25500W   Halibut -- Areas and seasons.   Notwithstanding the provisions of WAC 220-56-255:

     (1) Effective 12:01 a.m. June 15, 2001 until further notice, it is unlawful to fish for and possess halibut taken in those waters of Marine Area 1.

     (2) Effective immediately until further notice, it is unlawful to fish for and possess halibut taken in those waters of Marine Area 2, except open 12:01 a.m. June 17, 2001 until further notice in those waters from the Queets River south to 47° 0' North latitude and east of 124° 40' West longitude. Open seven days per week.

     (3) Effective immediately until further notice, it is unlawful to fish for and possess halibut taken in those waters of Marine Areas 3 and 4, except open only 12:01 a.m. June 16 to 11:59 p.m. June 16, 2001.

REPEALER

     The following section of the Washington Administrative Code is repealed:
WAC 220-56-25500V Halibut areas and seasons. (01-98)
