EMERGENCY RULES

DEPARTMENT OF

FISH AND WILDLIFE

[ Order 05-21 -- Filed February 15, 2005, 4:19 p.m. , effective March 1, 2005 ]

Purpose: Amend personal use fishing rules.

Citation of Existing Rules Affected by this Order: Repealing WAC 232-28-61900E; and amending WAC 232-28-619.

Statutory Authority for Adoption: RCW 77.12.240.

Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.

Reasons for this Finding: The 2004/2005 wild winter steelhead runs for the Snohomish and Stillaguamish River systems are forecasted to be below escapement needs. Predicted wild steelhead run sizes for the river systems are anticipated to be approximately 44% of wild steelhead escapement requirements. There are no harvestable fish (surplus) on the two river systems. Closures will eliminate potential hooking mortality and disturbance of spawning fish. There is insufficient time to promulgate permanent rules.
