PREPROPOSAL STATEMENT OF INQUIRY

OFFICE OF MINORITY AND

WOMEN'S BUSINESS ENTERPRISES

     Subject of Possible Rule Making: Amending WAC 326-20-115 to allow use of a declaration by the owner(s) of a business applicant in place of a sworn statement by the owner(s) of a business applicant for the application for certification, application for recertification and annual update, unless a sworn statement is specifically required by federal law or regulation.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 39.19.030.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Chapter 39.19 RCW does not require the signature on the application for certification, application for recertification, and the annual update to be notarized. Federal law or regulation may require a sworn statement on some documents. Use of a declaration will streamline the certification, recertification and annual update application processes and less [lessen] the burden on businesses.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

     Process for Developing New Rule: This is a rule that will govern the actions of the office and is not subject to violation by a nongovernment party.
