PREPROPOSAL STATEMENT OF INQUIRY

HORSE RACING COMMISSION

     Subject of Possible Rule Making: WAC 260-34-020 Drug and alcohol violations.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 67.16.020.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The commission is beginning rule making in contemplation of lower [lowering] the maximum allowable alcohol concentration for licensees or applicants on horseback while acting in an official capacity or participating directly in horse racing.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

     Process for Developing New Rule:       Negotiated rule making.
