     The Access to Justice Board having recommended the adoption of the proposed New GR 35-Clerk's Fees and Charges, and the Court having approved the proposed new rule for publication by order dated February 12, 2010, with the comment period to end on May 31, 2010. The Court having further determined that the comment period should be extended;

     Now, therefore, it is hereby

     ORDERED:

     (a) Comments are to be submitted to the Clerk of the Supreme Court by either U.S. Mail or Internet E-Mail by not later than August 31, 2010. Comments may be sent to the following addresses: P.O. Box 40929, Olympia, Washington 98504-0929, or Camilla.Faulk@courts.wa.gov. Comments submitted by e-mail message must be limited to 1500 words.

New Rule 35 - Clerk's Fees and Charges

     (C) Purpose

     This rule is intended to promote broader access to justice for people lacking the financial means to pay initial filing fees and other litigation fees and charges. Fees and charges that prevent courts from considering meritorious cases effectively bar justice to the indigent. This rule is intended to ensure that only those fees and charges that have been specifically authorized by statute or the Supreme Court will be assessed as a prerequisite to access to the judicial process.

RULE 35. CLERK'S FEES AND CHARGES



     Court clerks shall neither charge nor collect any fee or charge, except as authorized by statute or by the Supreme Court.
