PREPROPOSAL STATEMENT OF INQUIRY

DEPARTMENT OF HEALTH

     Subject of Possible Rule Making: Chapter 246-802 WAC, amending acupuncturists rules to reflect new East Asian medicine practitioner law.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: Chapter 18.06 RCW, SSB 6280 (chapter 286, Laws of 2010).

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: SSB 6280 (chapter 286, Laws of 2010) passed during the 2010 legislative session. Rule making is necessary to align the current rules with the new legislation. The rules need to be updated to include the requirements established by the bill, including approved exams and didactic and clinical courses in East Asian medicine and patient waiver requirements. The rules will also be reviewed for general housekeeping changes and clarifications, including changing the reference of certification to license, and clarifying the inactive status requirements.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

     Process for Developing New Rule: Collaborative rule making.

     Interested parties can participate in the decision to adopt the new rule and formulation of the proposed rule before publication.
