PREPROPOSAL STATEMENT OF INQUIRY

HEALTH CARE AUTHORITY

     Subject of Possible Rule Making: WAC 182-550-1200 Restrictions on hospital coverage and possibly other related chapters and sections as necessary.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: Section 213, chapter 50, Laws of 2011 (2ESHB 1087), RCW 41.05.021, 43.88.290.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Pursuant to 2ESHB 1087, effective October 1, 2011, the health care authority (HCA) is directed to restrict coverage of emergency room visits that do not meet the definition of emergency services according to WAC 182-550-1050.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

     Process for Developing New Rule: HCA welcomes the public to take part in developing the rules. Anyone interested should contact the staff person identified below. At a later date, HCA will file a proposal with the office of the code reviser with a notice of proposed rule making. A copy of the proposal will be sent to everyone on the mailing list and to anyone who requests a copy.
