PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: In 2013-15 Biennial Appropriations Act, the legislature funded K-1 high poverty class size for the 2014-15 school year only up to the school's demonstrated class size with a minimum class size of 20.3. These rules address the details and methodology of the K-1 high poverty staffing compliance calculation as required by the legislature.
Statutes Authorizing the Agency to Adopt Rules on this Subject: This is necessary to ensure that school districts funding aligns with the legislative intent per the Appropriations Act.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Without these rules, we will have no clear definition of compliance, nor method for determining which schools should actually receive the funding based on the smaller class size.

Process for Developing New Rule: Negotiated rule making.
