EMERGENCY RULES
DEPARTMENT OF
FISH AND WILDLIFE
[Order 15-434—Filed November 25, 2015, 4:08 p.m., effective December 1, 2015, 8:00 a.m.]
Effective Date of Rule: December 1, 2015, 8:00 a.m.
Purpose: Amend Puget Sound recreational crab fishing rules.
Citation of Existing Rules Affected by this Order: Repealing WAC 220-56-33000U and 220-56-33000W; and amending WAC 220-56-330.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This rule reopens the recreational crab fishery in Marine Area 10 for the month of December in addition to all other Puget Sound marine areas which were already opened October 1, 2015, in the previous emergency regulation WSR 15-20-026. It adjusts the open days per week to allow for inclement winter weather similar to the previous emergency regulation. Available harvest shares allow the areas to be opened in this rule. There is insufficient time to adopt permanent rules.
