PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: Highly capable program, chapter 392-170 WAC.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 28A.185.030, 28A.185.050.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: E2SSB 6362 (2018) added a new section to chapter 28A.300 RCW. The changes go into effect for the 2018-19 school year. New language added to the statute addresses requirements that districts follow criteria specified in the law when identifying students for highly capable services. The superintendent of public instruction is directed to require districts to follow these criteria and to disseminate guidance that is updated and aligned with evidence-based practices.
Process for Developing New Rule: Early solicitation of public comments and recommendations respecting new, amended, or repealed rules, and consideration of the comments and recommendations in the course of drafting rules.
