EMERGENCY RULES

Effective Date of Rule: Immediately upon filing.
Purpose: Amends recreational fishing rules for the Skagit River.
Citation of Rules Affected by this Order: Repealing WAC 220-312-04000Z; and amending WAC 220-312-040.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, 77.12.045, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This emergency rule is needed to close a portion of the Skagit River to all fishing to avoid gear conflicts with treaty Indian fisheries on these dates. There is insufficient time to adopt permanent rules.

WAC 220-312-04000AFreshwater exceptions to statewide rulesPuget Sound.
Notwithstanding the provisions of WAC 220-312-040, effective immediately through December 31, 2018:
(a) Skagit River, from the mouth to a line projected across the thread of the river 200' upstream of the mouth of the Baker River:
(i) Closed to all fishing the dates of October 22 through 12:00 p.m. October 23, 2018.
(ii) Salmon: Daily limit 4, up to 2 wild coho may be retained. Release Chinook and chum.
(b) Skagit River from a line projected across the thread of the river 200' upstream of the mouth of the Baker River to Cascade River Rd. (Marblemount Bridge): Salmon: Daily limit 4, up to 2 wild coho may be retained. Release Chinook and chum.
REPEALER
The following section of the Washington Administrative Code is repealed effective immediately:
