  Requiring motor carrier drug testing programs.


    AN ACT Relating to motor carrier drug testing programs; adding a new section to chapter 81.80 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 81.80 RCW to read as follows:

    (1) Any person or entity operating as a motor carrier shall comply with the requirements under the United States department of transportation federal motor carrier safety regulations for implementing a motor vehicle driver drug testing program.  Any person or entity in violation of this section shall be fined five thousand dollars and an additional five hundred dollars for each motor vehicle driver employed by the person or entity who is not in compliance with the motor vehicle driver drug testing requirements.

    (2) No person or entity may operate as a motor carrier who is not in compliance with this section.
