On page 1, line 11, after "(2)" insert "(a)"

     On page 1, beginning on line 14, after "transfer." strike all material through "transfer." on line 18, and insert the following:
     "(b) The rules may not require prior notice when marine fuel outlets are transferring less than three thousand gallons of oil in a single transaction to a ship that is not a covered vessel and the transfers are scheduled less than four hours in advance, unless the department has determined, under criteria established in rule, that an individual marine fuel outlet poses an elevated risk."
