On page 9, after line 12 of the amendment, insert the following:
"Sec. 6 RCW 82.08.0267 and 1980 c 37 s 34 are each amended to
read as follows:
(1) Subject to the requirements of subsection (2) of this section,
the tax levied by RCW 82.08.020 shall not apply to sales of poultry for
use in the production for sale of poultry or poultry products.
(2) Prior to January 1, 2026, the exemption authorized under
subsection (1) of this section does not apply to the sale of poultry
that will be used in the production of eggs unless the buyer provides
certainty that the facilities of the commercial egg layer operation
using the poultry are in, and will remain in, full compliance with the
provisions of section 3(4) of this act prior to the date by which the
commercial egg layer operation is required to be in compliance with
that subsection.
Sec. 7 RCW 82.12.0262 and 1980 c 37 s 61 are each amended to read
as follows:
(1) Subject to the requirements of subsection (2) of this section,
the provisions of this chapter shall not apply in respect to the use of
poultry in the production for sale of poultry or poultry products.
(2) Prior to January 1, 2026, the exemption authorized under
subsection (1) of this section does not apply to the use of poultry in
the production of eggs unless the buyer provides certainty that the
facilities of the commercial egg layer operation using the poultry are
in, and will remain in, full compliance with the provisions of section
3(4) of this act prior to the date by which the commercial egg layer
operation is required to be in compliance with that subsection."
Renumber the remaining sections consecutively and correct any internal references accordingly.
EFFECT: Conditions the sales and use tax exemption for poultry used for the production of poultry and poultry products so that poultry being bought for use in egg production is only granted the exemption if the commercial egg layer operation is in full compliance with the American Humane Association's facility housing system plan and audit protocol as it existed on January 1, 2011, prior to the date by which all commercial egg layer operations must be in compliance with the plan.
