On page 2, line 15, after "megawatts" insert "; or (b) electricity generated from a small hydropower facility with a generating capacity of ten megawatts or less that meets the following criteria: (i) The facility commenced operation after 2008; (ii) the facility is operated by a qualifying utility; (iii) the diversion and powerhouse are above a natural barrier to migrating fish; and (iv) the facility is outside federal wilderness areas or federal wild and scenic river corridors"
EFFECT: Adds the following to the definition of "distributed generation": (b) Electricity generated from a small hydropower facility with a generating capacity of ten megawatts or less that meets the following criteria: (i) The facility commenced operation after 2008; (ii) the facility is operated by a qualifying utility; (iii) the diversion and powerhouse are above a natural barrier to migrating fish; and (iv) the facility is outside federal wilderness areas or federal wild and scenic river corridors.
