Beginning on page 1, line 3 of the amendment, strike all material through page 10, line 2 and insert the following:
"NEW SECTION. Sec. 1 A new section is added to chapter 47.01 RCW
to read as follows:
Construction of the Interstate 405/Kirkland Vicinity - Stage 2
widening project, funded in part by the 2003 nickel funding package,
must be constructed as soon as practicable to provide additional
general purpose lane capacity on Interstate 405. Elements of the
project may include underground features only, such as conduit,
necessary to accommodate potential future toll lanes.
NEW SECTION. Sec. 2 A new section is added to chapter 47.01 RCW
to read as follows:
The commission shall retain appropriate independent experts and
conduct a traffic and revenue analysis for the development of a forty-mile continuous express toll lane system and an all-lane flat rate
tolled system that includes state route number 167 and Interstate 405.
The analysis must include a review of the following variables within
the express toll lane system:
(1) Vehicles with two or more occupants are exempt from payment;
(2) Vehicles with three or more occupants are exempt from payment;
(3) A variable fee; and
(4) A flat rate fee."

On page 10, beginning on line 4 of the title amendment, after "insert" strike the remainder of the title and insert "and adding new sections to chapter 47.01 RCW."
EFFECT: Directs WSDOT to proceed with the planned capital construction project on I-405 as a project to build additional general purpose lane capacity. Directs the Transportation Commission to complete a traffic and revenue study on I-405 and SR 167 that would examine the option of express toll lanes, and also an all-lane flat rate tolled system.
