Concerning equity and fairness through the creation and regulation of electronic scratch ticket machines for nontribal gambling establishments.


Establishes the gaming equity and fairness act of 2011.

Extends electronic scratch ticket games to house-banked card room licensees.

Creates the gaming equity and fairness account.

Requires the lottery commission to retain thirty-five percent of the net win from electronic scratch ticket games and deposit the proceeds in the gaming equity and fairness account.

Providing for fairness, equity, and transparency of tax preferences for federally recognized Indian tribes.


Establishes the tribal tax oversight act of 2011.

Eliminates special tax preferences given to federally recognized Indian tribes in recent years and provides for additional requirements for the renewal of existing tax agreements.

Concerning legislative involvement with compacts and compact amendments.


Establishes the contractual oversight and transparency act.

Prohibits the governor from adopting, executing, or otherwise entering into any compact with another state, the federal government, Indian tribe or band, or other sovereign entity without prior legislative approval.

Provides that the gambling commission, when negotiating compacts with federally recognized Indian tribes, should include an expectation that the tribe will make payments to the state based on the gross gaming revenue generated from all class III gaming activities.

Concerning oversight of licensed or certified long-term care settings for vulnerable adults.


(DIGEST OF PROPOSED 2ND SUBSTITUTE)


Addresses current statutes and funding levels that limit the department of social and health services' ability to promote vulnerable adult protections.

Expands licensing requirements and imposes additional civil penalties for adult family home providers.

Requires the department of social and health services to: (1) Use additional investigative resources to address a significant growth in the long-term care complaint workload;

(2) Develop a statewide internal quality review and accountability program for residential care services; and

(3) Adopt rules to specify criteria on how to apply sanctions with increasing severity.

Requires the state long-term care ombudsman to convene an adult family home quality assurance panel to review problems concerning the quality of care of residents and abuse and neglect in adult family homes, and the oversight of adult family homes by the department of social and health services.

Creates a separate adult family home account in the custody of the state treasurer to be used only for promoting the quality of life and care of residents living in adult family homes.

Provides that sections 501 through 503 of the act are null and void if appropriations are not approved.
