     On page 9, beginning on line 4, after "(b)" strike all material through "dam." on line 11 and insert "(i) The department of ecology may require by rule a tug escort or escorts for an oil tanker entering within a two-mile radius of the Grays Harbor pilotage district as defined in RCW 88.16.050.
     (ii) As provided in section 8 (2) and (3) of this act, under limited circumstances to address specific spill risks, the department of ecology may require by rule an escort by a single tug for an oil tanker entering within three miles of Cape Disappointment at the mouth of the Columbia river or any inland portion of the Columbia river up to the Bonneville dam.

     On page 10, line 16, after "88.16.190(1)." insert "The department may not adopt rules to require all oil tankers entering the areas listed in RCW 88.16.190(1)(b)(ii) to be escorted by a tug or tugs. The department may, however, adopt rules to address specific spill risks in limited circumstances pursuant to subsection (3) of this section in the areas listed in RCW 88.16.190(1)(b)(ii). The department's rules may include a requirement for an oil tanker entering the areas listed in RCW 88.16.190(1)(b)(ii) to be escorted by a single tug in limited circumstances to address specific spill risks pursuant to subsection (3) of this section."

EFFECT:  Narrows the Department of Ecology's Columbia River tug escort rule-making authority to an authority to require an escort by a single tug under specific circumstances based on season, adverse weather conditions, type of oil, or geographic location.
