On page 3, after line 7, insert the following:
"(c) Local jurisdictions must make a school concurrency
determination ensuring available capacity within three months of
issuance of the residential building permit before issuing the
residential building permit when the applicant requests to defer the
payment of school impact fees pursuant to (a) of this subsection (3)."
EFFECT: Requires a determination that within three months there is sufficient school capacity to serve the proposed development.
