     AN ACT Relating to culinary class wine restaurant specialty licenses; adding a new section to chapter 66.24 RCW; and prescribing penalties.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION.  Sec. 1   A new section is added to chapter 66.24 RCW to read as follows:
     (1) There is a wine retailer's license to be designated as a culinary class restaurant wine specialty license to provide or sell wine by the glass or the bottle to accompany meals prepared for the public for a fee as part of the formal training activities regularly conducted by a designated culinary class. The annual fee for the license is two hundred fifty dollars.
     (2) For the purposes of this section the following definitions apply:
     (a) "Culinary class" means a class offered by a for-profit or nonprofit educational institution operating for the purpose of training students in the culinary arts, including the teaching of classes related to the selection, purchase, preparation, storage, and serving of food to the general public in a restaurant setting.
     (b) "Culinary class restaurant" means a restaurant, as defined in RCW 66.24.410, operating in conjunction with a culinary class, which provides the public with meals prepared as part of the curriculum of the culinary class.
     (3) Licensees under this section may provide, free or for a charge, single servings of six ounces or less of wine to culinary class restaurant customers for consumption on the premises as part of a meal purchased from the culinary class restaurant.
     (4) Customers of licensees under this section may purchase bottles of wine offered for sale for consumption on the premises as part of a meal purchased from the culinary class restaurant.     
     (5)(a) The board may issue a culinary class special event endorsement at the discretion of the board to a licensee to provide or sell wine off premises at culinary class events approved by the board. The off-premises events subject to the endorsement must be conducted by the culinary class restaurant and be directly related to the licensee's training curriculum and related restaurant activities. The fee for the endorsement is sixty dollars per day of the endorsed event. This endorsement must:
     (i) Designate the specific time, place, and premises of the specified event and restrict such events to taking place twenty calendar days per year or less.
     (ii) Provide that the sales, service, and consumption of wine are restricted to specified premises or designated areas only and are subject to all other regulations set forth under this section.
     (iii) Require that wine sold is purchased from a licensee of the board.
     (b) Any violation of this subsection (5) is a class 1 civil infraction having a maximum penalty of two hundred fifty dollars as provided for in chapter 7.80 RCW.
     (6) Except as otherwise provided under this section, the service or sale of wine by students or employees of the licensee must comply with the regulations and requirements applicable to other wine restaurant licensees under RCW 66.24.400, 66.24.410, and 66.24.420.
     (7) Licensees under this section must provide training as prescribed by the board by rule for students, employees, or other individuals who serve or sell wine, or who manage others who serve or sell wine, regarding compliance with laws and regulations applicable to serving wine to the public. The training must be provided before the individual first engages in the sale of wine and must be renewed at least every five years. Records must be maintained documenting the nature and frequency of the training provided.
     (8) The board may adopt rules, as the board deems necessary, to implement this section.
