Providing procedures for responding to reports of threatened or attempted suicide.


(DIGEST OF PROPOSED 2ND SUBSTITUTE)


Requires a peace officer responding to a report of threatened or attempted suicide to notify a designated mental health professional agency that the person who is the subject of the report may be in need of a mental health evaluation if: (1) The officer does not take the person into custody; and

(2) The officer knows, based on the information available to him or her, that the person has been the subject of a previous report of threatened or attempted suicide within the last twelve months.

Requires a mental health professional contacted by the designated mental health professional agency to attempt to contact the person who is the subject of the report to determine whether additional mental health intervention is necessary.

Requires law enforcement agencies to have a system in place by January 1, 2017, for officers to document, as part of an incident report, the need for a mental health evaluation of a person who is the subject of a report of threatened or attempted suicide.

Establishes the Washington fair chance act.

Prohibits an employer from: (1) Excluding an applicant from an initial interview solely because of a criminal record; and

(2) Advertising employment openings in a way that excludes people with a criminal record from applying.

Prohibits advertising that states "no felons" or "no criminal background" or that otherwise conveys similar messages.

Allows an employer to consider an applicant's criminal record before making a hiring decision.

Requires the attorney general's office to enforce this act.

Integrating the treatment systems for mental health and chemical dependency.


(DIGEST OF PROPOSED 2ND SUBSTITUTE)


Establishes Ricky Garcia's act.

Requires the department of social and health services to combine the functions of a designated mental health professional and designated chemical dependency specialist by establishing a designated crisis responder who is authorized to conduct investigations, detain persons up to seventy-two hours to the proper facility, and carry out the other functions identified in chapter 71.05 RCW (mental illness) and chapter 71.34 RCW (mental health services for minors).

Requires the behavioral health organizations to provide training to persons converting to designated crisis responders, as required by the department of social and health services, which must include both mental health and chemical dependency training applicable to the designated crisis responder role.

Requires the state institute for public policy to evaluate the effect of the integration of the involuntary treatment systems for substance use disorders and mental health and make preliminary reports to the appropriate legislative committees.

Provides that this act is null and void if appropriations are not approved.

(DIGEST OF PROPOSED 2ND SUBSTITUTE)


Specifies that a primary role of school counselors, social workers, and psychologists is to: (1) Focus on student mental health;

(2) Work with at-risk and marginalized students;

(3) Perform risk assessments; and

(4) Collaborate with mental health professionals to promote student achievement and create a safe learning environment.

Requires first-class school districts to, on a monthly basis throughout each school year, provide a minimum of one hour of professional collaboration for school counselors, social workers, and psychologists that focuses on recognizing signs of emotional or behavioral distress in students.

Requires school districts that have mental health centers in their area to collaborate with local licensed mental health service providers under the community mental health services act.

Creates the professional collaboration lighthouse grant program to assist school districts with early adoption and implementation of mental health professional collaboration time.

Requires the superintendent of public instruction to designate two school districts as lighthouse school districts to serve as resources and examples of best practices in designing and operating the professional collaboration program.

Exempts the following from providing a social security number: An applicant for a nondomiciled commercial driver's license or commercial learner's permit who is domiciled in a foreign country and who has not been issued a social security number.

Authorizes the department of licensing to issue a nondomiciled commercial driver's license or commercial learner's permit to a person who is a nonresident if certain conditions are met.

Requiring a minimum of five years' notice on closures or conversions of mobile home parks and manufactured housing communities.


Requires a written rental agreement for a manufactured/mobile home space tenancy to contain: (1) A covenant by the landlord that, except for acts or events beyond the control of the landlord, the mobile home park will not be converted to a land use that will prevent the space that is the subject of the lease from continuing to be used for its intended use for a period of five years after the beginning of the term of the rental agreement; and

(2) A copy of a closure notice if a closure notice is in effect.

Requires a tenant who sells a mobile home, manufactured home, or park model within a park to provide the buyer with a copy of any closure notice provided by a landlord at least seven days in advance of the intended sale and transfer.

Abolishes the state board of education and transfers its powers, duties, and functions to the department of education.

Exempts the following from the provisions of the state civil service law: The department of education and the director, the director's personal secretary, the deputy director, all division directors and assistant directors, and one confidential secretary for each of these officers.

Takes effect July 1, 2019, if the proposed amendment to Article III, sections 1, 3, 10, 22, and 24 of the state Constitution, eliminating the office of the superintendent of public instruction, is approved by the voters at the next general election.

Adds the definition of "posting in a conspicuous manner," for purposes of chapter 9A.52 RCW (burglary and trespass), which includes: (1) Posting a sign reasonably likely to come to the attention of intruders indicating that entry is restricted; or

(2) If the property is located outside of urban growth areas and incorporated cities or towns, the placement of identifying fluorescent orange paint marks on trees or posts on property.

Encourages the department of fish and wildlife, the department of natural resources, and the parks and recreation commission to use their web sites and appropriate publications to inform the public that vertical orange marks on trees or posts may indicate a private boundary line and crossing it without first securing the owner's permission is trespassing.

Streamlining foster care licensing.


(DIGEST OF PROPOSED 1ST SUBSTITUTE)


Requires the department of social and health services, in order to streamline the foster care application process for child-placing agencies when processing a child-placing agency application, to: (1) Accept scanned foster care parent applications that include an original signature electronically;

(2) Complete and return background authorization forms within thirty days or provide explanation to either the prospective parent, the child-placing agency, or both about why there is a delay;

(3) Ensure that the forms required across the state are uniform and consistent between regions;

(4) If related department forms change after the foster care application has been received by the department, not require the applicant to resubmit information on a substantially similar form;

(5) Ensure that foster care parent applications are processed in a timely manner; and

(6) E-mail the fingerprint original case agency number to a child-placing agency within five business days of receipt of the fingerprint-based background notice from the family or child-placing agency.

(3) Work with the department of commerce and other economic development stakeholders to facilitate the development of the state as a national leader in cybersecurity.

Requires a local government that prohibits the disposal of food waste and compostable paper as garbage to: (1) Ensure that a solid waste management plan it prepares, under chapter 70.95 RCW (solid waste management--reduction and recycling), prevents the spread of disease, plant pathogens, and pests to areas that are not under a quarantine; and

(2) Consult with the department of agriculture to determine if the plan complies with this act before submitting the plan to the department of ecology for approval.

Requires certain standards set by the department of ecology, for counties or cities siting a solid waste disposal facility, to include information relating to preventing the spread of disease, plant pathogens, and pests to areas that are not under a quarantine.

Requires the department of agriculture to review certain permits issued by a jurisdictional health department, with regard to solid waste handling facilities, to ensure that the proposed site or facility conforms with applicable laws and regulations relating to preventing the spread of disease, plant pathogens, and pests to areas that are not under a quarantine.

(3) Assist borrowers to understand their rights and responsibilities under the terms of loans;

(4) Provide information on, and make recommendations for resolving, the problems and concerns of borrowers;

(5) Analyze and monitor the development and implementation of all laws, rules, regulations, and policies relating to borrowers and recommend changes as necessary;

(6) Review the complete loan history for a borrower who has provided written consent for the review; and

(7) Disseminate information concerning the availability of the ombuds to assist borrowers, potential borrowers, and others with student loan servicing concerns.
