    On page 34, line 38, after "professional;" strike "and"

    On page 35, line 4, after "agreement" insert "; and

    (e) Not be currently incarcerated in any state jail or state or federal prison and must have completed a criminal background check.  The criminal background check must be conducted by the department of social and health services and must be paid for by the intended parents."

EFFECT:   Provides that, in order to enter into a surrogacy agreement, the intended parent or parents must not be currently incarcerated in a state jail or a state or federal prison and must have completed a background check conducted by the Department of Social and Health Services.
