On page 3, after line 2 of the amendment, insert the following:

NEW SECTION.  Sec. 3.  "A new section is added to chapter 46.61 RCW to read as follows:

The unlawful operation of a vehicle in violation of section 1 of this act is prima facie evidence of operation of a motor vehicle in a reckless manner for the purposes of RCW 46.61.520 and 46.61.522."

Renumber the remaining sections consecutively and correct any internal references accordingly.

EFFECT: If a person using an electronic device causes a death or substantial bodily harm while using a personal electronic device while driving, the use is prima facie evidence of operating a vehicle in a reckless manner.
