AN ACT Relating to public employer collection and remission of dues and other amounts on behalf of labor organizations; adding a new section to chapter
41.56 RCW; adding a new section to chapter
47.64 RCW; adding a new section to chapter
28B.52 RCW; adding a new section to chapter
41.59 RCW; adding a new section to chapter
41.80 RCW; adding a new section to chapter
49.39 RCW; adding a new section to chapter
41.76 RCW; and creating a new section.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. The legislature finds that the state and local employers cover the administrative costs of dues and other voluntary withholding collections and remittance as well as other costs related to administering collective bargaining. The legislature intends to cover a portion of the cost by retaining a small amount of the dues and other amounts collected on behalf of and remitted to public employee unions to cover a portion of the costs associated with the public employment relations commission.
NEW SECTION. Sec. 2. A new section is added to chapter 41.56 RCW to read as follows:
(1) A public employer that collects and remits dues and other amounts on behalf of a labor organization may retain up to five percent of the amount collected to offset the cost of administration.
(2)(a) The office of financial management shall establish the amount retained by state agencies under subsection (1) of this section. The rate must be the higher of: (i) At least two percent, or (ii) a level that ensures that the funds retained are no less than one-half of the total amount appropriated to the public employment relations commission during the previous fiscal biennium.
(b) The amount retained by state agencies under this section must be deposited to the personnel service fund under RCW
41.06.270 and used for costs of the public employee relations commission.
NEW SECTION. Sec. 3. A new section is added to chapter 47.64 RCW to read as follows:
