AN ACT Relating to requiring health care providers sanctioned for sexual misconduct to notify patients; adding a new section to chapter 18.130 RCW; and providing an effective date.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION.  Sec. 1. A new section is added to chapter 18.130 RCW to read as follows:
(1) A licensee subject to this chapter that has been sanctioned by a disciplining authority for sexual misconduct must provide a disclosure to all patients before a patient's first visit with the licensee following the sanction while the licensee is subject to oversight by a disciplining authority.
(2) The disclosure must include the date of the sexual misconduct sanction, a description of all sanctions placed on the licensee by the disciplining authority, the duration of all sanctions, the disciplining authority's telephone number, and an explanation of how the patient can find more information about the licensee on the disciplining authority's online license information web site.
(3) The licensee must provide the patient or the patient's surrogate decision maker designated under RCW  7.70.065 with the disclosure, which must be signed by the patient or the surrogate decision maker.
NEW SECTION.  Sec. 2. This act takes effect October 1, 2019.
