EFFECT: Amends the definition of "microenterprise home kitchen operation" (MHKO). Provides that a local health jurisdiction (LHJ) may elect to administer the pilot program directly rather than delegating to the Department of Health (DOH). Provides that a LHJ may be reimbursed for the costs associated with fulfilling their responsibilities in the joint plan of responsibility. Authorizes DOH to permit and inspect up to 300 MHKOs. Removes restrictions that food produced in a MHKO may not be held hot for more than two hours or be held overnight. Establishes that DOH may align exemptions for MHKOs with the exemptions for Bed and Breakfast operations. Removes the provision that state board rules may be based on DOH recommendations. Provides that MHKOs expire June 30, 2025, unless the pilot program is extended or a permanent MHKO program is established by the Legislature. Clarifies the hours during which an inspection may occur. Requires DOH to include the number of applications denied in its annual report. Makes technical changes.
