EMERGENCY RULES
FISH AND WILDLIFE
Date of Adoption: May 23, 2000.
Purpose: Amend personal use rules.
Citation of Existing Rules Affected by this Order: Repealing WAC 220-56-33000A; and amending WAC 220-56-330.
Statutory Authority for Adoption: RCW 75.08.080.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: Crab hard shell conditions meet the criteria needed for harvest in portions of Marine Areas 8-1, 9 and all waters of Marine Areas 8-2 and 10. There is insufficient time to promulgate permanent rules.

Notwithstanding the provisions of WAC 220-56-330, effective 8:00 a.m., May 24, 2000 until further notice it is lawful to fish for crab for personal use with crab pot gear in the following areas:
(1) Marine Area 8-1, except contiguous waters south of a line from Rocky Point to Dines Point on Whidbey Island.
(2) Marine Area 8-2.
(3) Marine Area 9, except contiguous waters south of a line from Foulweather Bluff to Olele Point.
(4) Marine Area 10.
