PREPROPOSAL STATEMENT OF INQUIRY

     Subject of Possible Rule Making: Chapter 388-835 WAC, ICF/MR program and reimbursement system, and other rules as appropriate. The Division of Developmental Disabilities is adopting rules to implement the 2003-2005 state operating budget bill (section 205, chapter 25, Laws of 2003 1st sp.s.). In budget detail documents, the state legislature directed that: "The department shall consolidate vacancies across all residential habilitation centers (RHCs) in order to downsize Fircrest School."

     Statutes Authorizing the Agency to Adopt Rules on this Subject: Chapter 71A.20 RCW, RCW 71A.12.080, 71A.20.140.

     Other Authority: Section 205, chapter 25, Laws of 2003 1st sp.s.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Rules are needed to establish procedures to transfer residents of the Fircrest School to other facilities or care settings.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: Centers for Medicare and Medicaid.

     Process for Developing New Rule: At a later date, the department will file a proposed rule and proposed rule-making notice for publication in the state register, invite public comments and hold a public hearing. The proposal will be sent to everyone on the mailing list to receive rule-making notices on this subject, and to anyone who requests the proposal.
