PREPROPOSAL STATEMENT OF INQUIRY

HORSE RACING COMMISSION

     Subject of Possible Rule Making: Chapter 260-84 WAC, Penalties, to adopt into rule the model rules for penalties for violation of equine medication rules recommended by the racing medication and training consortium and adopted by the Association of Racing Commissioners International. Chapter 260-70 WAC, Controlled medication program, to amend as appropriate sections of chapter 260-70 WAC that may be necessary to identify all the drugs and substances necessary to adopt the model penalty rules.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 67.16.020.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: To adopt the applicable model rules related to equine medication and penalties. This will assist the industry by creating consistency in equine rules and penalties from one jurisdiction to another.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

     Process for Developing New Rule:       Negotiated rule making.
