PREPROPOSAL STATEMENT OF INQUIRY

     Subject of Possible Rule Making: WAC 388-428-0010 Request for address disclosure by a parent when a child is living with a nonparental caretaker; 388-454-0025 The department notifies a child's parent when we approve assistance and the child is living with someone other than their parent; and related WAC governing the requirement to notify parents when a child is out of the home.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 13.32A.082, 13.32A.090, chapter 74.12 RCW, 74.04.050, and 74.08.090.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: WACs governing the notification to parents of the whereabouts of their children need to be changed to comply with the requirements of RCW in a manner which recognizes the rights of the parents and maintains the safety of children.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

     Process for Developing New Rule: DSHS welcomes the public to take part in developing the rules. Anyone interested should contact the staff person identified below. At a later date, DSHS will file a proposal with the office of the code reviser with a notice of proposed rule making. A copy of the proposal will be sent to everyone on the mailing list and to anyone who requests a copy.
