Statutory Authority for Adoption: Chapter 41.06 RCW.
Statute Being Implemented: RCW 41.06.150.
Rule is not necessitated by federal law, federal or state court decision.
Agency Comments or Recommendations, if any, as to Statutory Language, Implementation, Enforcement, and Fiscal Matters: It has been suggested that we change the language in WAC 357-46-100(1) to mirror the language in WAC 357-16-125(7) which is easier to understand. This does not change the intent of WAC 357-46-100.

(1) ((General government employers must certify
transition pool candidates when a certified pool contains
eligible candidates other than layoff or internal promotional
candidates)) General government employers must provide for
consideration of transition pool candidates when a certified
pool contains eligible candidates other than candidates from
the employer's internal or statewide layoff list or the
employer's internal promotional eligibles.
(2) Transition pool candidates must satisfy the competency and other position requirements to be considered for a position.
