PREPROPOSAL STATEMENT OF INQUIRY

DEPARTMENT OF TRANSPORTATION

     Subject of Possible Rule Making: Revision of WAC 468-38-073(6) to comply with revision to federal rule. Specifically, the rule will be amended to provide a weight allowance, up to four hundred pounds, for the application of "idle reduction technology."

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 46.44.090.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Without revision to the rule, the state will not comply with the federal code.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: Federal Highway Administration (FHWA); Washington State Patrol (WSP). FHWA is used as a compliance resource during rule development. WSP has a primary review and comment role during rule development.

     Process for Developing New Rule: Need for revision is the direct result of a revision in federal rule. The process includes regulatory and industry review.
