PREPROPOSAL STATEMENT OF INQUIRY

CONVENTION AND TRADE CENTER

     Subject of Possible Rule Making: Updates to chapter 140-09 WAC, Guidelines for implementing the State Environmental Policy Act (SEPA).

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 43.21C.120.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The Washington state convention and trade center (WSCTC) intends to update its SEPA rules in order to be consistent with state department of ecology SEPA rules, which have changed since initial adoption of the WSCTC rules.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: The Washington state department of ecology (DOE) is responsible for adopting rules to implement SEPA. DOE has adopted rules for the purpose of establishing uniform requirements for compliance with SEPA. Each agency must have its own SEPA procedures consistent with these statewide rules, WAC 197-11-020. WSCTC intends to achieve this consistency by updating its rules. WSCTC will coordinate with DOE by providing it with a copy of any proposed rule change. WSCTC will also coordinate by ensuring that the WSCTC rules are consistent with DOE's adopted SEPA guidelines. Such consistency may be achieved through incorporation by reference of relevant DOE rules where appropriate.

     Process for Developing New Rule:      Agency study.
