PREPROPOSAL STATEMENT OF INQUIRY

DEPARTMENT OF LICENSING

     Subject of Possible Rule Making: Chapter 308-10 WAC, Public records disclosure, the department of licensing (DOL) is considering adopting new rules governing access to digital information including the internet vehicle/vessel processing system (IVIPS), the disclosure of electronic records, and expanding and updating definitions in WAC 308-10-010. IVIPS is a DOL application that allows the user to access current vehicle or vessel record information from a secure internet site.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 42.56.040, 43.17.060, and 43.24.016 (2)(d).

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: DOL is responsible for upholding the highest level of public confidence and trust as custodian of personally identifiable information, as well as providing fair and equitable access to that information by legally privileged parties. Rule making is required to govern the department's actions when providing access to vehicle and vessel information through an automated system. DOL also will be adopting portions of the model rules for disclosure of electronic records.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

     Process for Developing New Rule: DOL welcomes the public to take part in developing the rules. Anyone interested should contact the staff person identified below. At a later date, DOL will file a proposal with the office of the code reviser with a notice of proposed rule making.
