     At present, the public disclosure commission has two rules under development:

     1. Topic: Ratings and endorsements.

     Status: On October 10, 2007, the commission filed the preproposal statement with the code reviser giving notice that it is considering changes to WAC 390-16-206 Ratings and endorsements, to update the rule and to take into account the state supreme court ruling in San Juan et al. v No New Gas Tax (2007) to the extent it may impact the rule. A public hearing and possible adoption of the amended rule will occur on February 28, 2008. If adopted, the new and amended rule will likely go into effect in April of 2008.

     Statutory Authority: RCW 42.17.370(1).

     Statute Being Implemented: Chapter 42.17 RCW.

     WAC Cite: WAC 390-16-206 Ratings and endorsements.

     2. Topic: Reporting modifications.

     Status: The commission will file a preproposal statement with the code reviser giving notice that it is considering possible amendments to chapter 390-28 WAC.

     A public hearing and possible adoption of amended rules may occur on May 22, 2008. If adopted, the amended rule will likely go into effect in July of 2008.

     Statute Being Implemented: RCW 42.17.370(10).

     The commission will also review WAC 390-28-020 through 390-28-090 to the extent these rules are affected by amendments to WAC 390-28-100.
